Collective overtime lawsuit filed against TwoPro Energy Services

Oil and gas service provider, TwoPro Energy Services, LLC, has been sued in federal court in the Western District of Texas, Pecos division for violations of the Fair Labor Standards Act (“FLSA”).  The lawsuit was brought by a former field worker for unpaid overtime violations and alleges that workers for TwoPro typically worked over forty hours per week, seven days a week without being paid overtime. Specifically, TwoPro would pay its workers a different rate for each task performed. For example, if workers performed services under different categories, including Hotshotting, Field Time, Drive Time or Shop Time, each job was paid at a different rate. Unless a worker worked more than 40 hours in one job category, he or she was not paid overtime for any work done. 

The lawsuit seeks to have the case proceed as a collective action, whereby any individual:

  1. who was employed by TwoPro Energy Services, LLC in the past three years as a field worker; and
  2. denied overtime pay for any hours worked above forty in a week, is eligible to join the lawsuit.
