Lawsuit filed against Transglobal Services, LLC for unpaid overtime

Transglobal Services, LLC is the subject of a lawsuit from ten current and former employees alleging violations of the Fair Labor Standards Act (“FLSA”). The lawsuit  was filed on March 15, 2019 in federal court in Midland, Texas.  The suit alleges that the workers were hired by Transglobal as independent contractors, despite the fact that they worked full time and virtually every aspect of their jobs were controlled by Transglobal. The workers alleges that Transglobal failed to properly pay the workers overtime pay at a rate of time and a half for all hours worked over forty in a given workweek. 

Transglobal is a full service provider in the energy industry, primarily providing surveying, right of way and seismic services to oil and gas producers. Prior to the summer of 2018, Transglobal classified its workers as independent contractors, only having changed the classification to employees in mid- to late-2018. According to the lawsuit, misclassifying workers was an incentive for Transglobal because they did not have to pay employment taxes, workers’ compensation insurance, benefits and overtime. 

The lawsuit alleges that while employed by Transglobal, many of the workers worked 12-15 hours a day, six days a week, and were paid the same amount per hour for every hour, therefore never receiving overtime. According to the lawsuit, the workers were not given an opportunity to share in the profit or loss of the business, not allowed the freedom to accept or reject other assignments, and not allowed to expand their own businesses while working for Transglobal. The schedules, pay structures, and day-to-day tasks were controlled by Transglobal, who directed when and where the workers should report to work.
