Hinklin Pressure Washing, LLC has been sued in federal court in the Midland-Odessa area for violations of unpaid overtime and minimum wage. Hinklin Pressure Washing is an oilfield service company that provides oilfield and pipeline pressure washing, hydro excavating, and super vac trucks services. Plaintiffs were employed as truck drivers by Hinklin Pressure Washing, which is owned and controlled by James T. Hasty. Plaintiffs allege that they were not compensated for their drive time and therefore were denied their rightful overtime pay.
Additionally, Plaintiffs allege that they were not paid minimum wage as is required under the Fair Labor Standards Act (“FLSA”). Plaintiffs contend that when they had completed all their necessary work, their paychecks, which had already been deposited into Plaintiffs’ accounts, had been removed. This meant that Plaintiffs never received a paycheck for their work.
Under the FLSA, employers are required to pay their workers overtime compensation at a rate of one and a half times the appropriate regular rate. When Plaintiffs were paid hourly, they were not paid time a half for the hours worked above forty. In further violation of the FLSA, employers are required to pay their workers at a minimum wage rate of $7.25 per hour for all hours worked. Failing to pay employees minimum wage unjustly enriches the employer who has just received free labor.
